NYS Assembly Passes No Fault Divorce Bill PDF Print E-mail

The New York State Assembly Thursday passed a no-fault divorce bill.  New York is the last state to allow couples divorce when one spouse thinks the marriage is over.  Current laws state that the couple must enter a one year separation period, or assign blame to one spouse.  The current requirements for ending a marriage without the seperation period are adultery, abandonment, or cruelty.

The no-fault bill will allow one spouse to push for divorce stating underoath that the marriage has been dead for a minimum of six months.  One benefit to having a no-fault bill passed in New York is it would stop couples from making false accusations and causing unnecesary conflict.  This bill awaits a signature from Governor Paterson.
